Terms & Conditions
These Terms govern the Tradies Local marketplace used by homeowners, business owners and tradies. They are designed for an Australian marketplace where users connect and contract directly with each other.
Important marketplace notice
Tradies Local provides a digital marketplace and related platform services. Unless we expressly agree otherwise in writing, we are not the tradie, customer, employer, labour-hire provider, builder, contractor, supervisor, inspector, insurer, guarantor or agent for a user, and we are not a party to the contract for the underlying trade or employment services.
Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
1. Acceptance and eligibility
These Terms are between you and LOTAY PTY LTD (ABN 62 674 969 923), trading as Tradies Local Australia (“Tradies Local”, “we”, “us” or “our”), and govern the platform services you choose to use. The Platform Policies explain user standards and procedures. Purchase-specific descriptions and conditions form part of the relevant purchase; mandatory law prevails over any conflicting term. The Privacy Policy explains information handling and is not blanket consent to unrelated collection or marketing.
- You must be at least 18 and legally able to contract. An organisation's representative must have authority to act for it.
- Provide accurate, current information and keep it updated. Do not impersonate another person or create deceptive duplicate accounts.
- Account registration and purchases require an affirmative agreement to the applicable terms. Merely browsing does not authorise a payment, recurring subscription or marketing.
- Features described for a future release are not available or included unless expressly offered. If you do not accept the applicable terms, do not register or purchase.
2. Tradies Local's role
The marketplace covers accounts, profiles, listings, quotes, applications and responses. The Tool Box provides standalone planning calculators; it does not create listings, send messages or engage a tradie.
Tradies Local helps users discover opportunities, advertise jobs, display profiles, communicate, request or submit quotes, apply for work and use related marketplace features. The underlying trade, construction, repair, hiring or other service is supplied by the relevant user—not by Tradies Local.
What we do not guarantee
- that a job will receive responses, quotes or applications;
- that a tradie will obtain work or any minimum amount of revenue;
- the identity, availability, suitability, solvency, skill, workmanship, conduct or reliability of any user beyond the specific checks we expressly describe;
- the accuracy or completeness of user-generated information, quotes, reviews, credentials or job descriptions;
- that a licence, registration, ABN, insurance policy or other credential remains current after the date it was checked; or
- the quality, legality, safety, timing, price or outcome of any underlying work arrangement.
Verification badges and profile checks are information tools only. They are not an endorsement, recommendation, warranty or guarantee of workmanship.
3. Accounts and security
Keep login details confidential and promptly report suspected unauthorised access to support@tradieslocal.com.au. You are responsible for actions you authorise and for reasonable precautions within your control; you are not automatically responsible for activity caused by our security failure or conduct for which the law makes us responsible.
- Do not share, rent, sell or transfer an account without our written approval.
- We may request proportionate information needed for a disclosed credential check, account security or legal obligation. We may pause the affected feature while a material discrepancy is assessed.
- Do not provide passwords, one-time codes or unnecessary identity documents in public content or ordinary messages.
- Access is limited to the features and permissions of your account. Security testing, harvesting data and bypassing access controls require express permission.
4. Responsibilities by user type
Homeowners and other customers
- Describe the job accurately, including known conditions that may affect scope, access, safety or price.
- Do not publish unnecessary sensitive information, including a precise street address, access code or security information, in a public job listing.
- Before engaging a tradie, independently consider the tradie's suitability, scope, quote, licence where required, insurance, availability and contractual terms.
- Obtain any owner, body corporate, landlord, planning, building or other approvals that are your responsibility.
- Pay the selected tradie in accordance with the contract you make with that tradie.
Business owners and hiring users
- Ensure job advertisements, recruitment, engagement and workplace practices comply with applicable employment, contractor, discrimination, work health and safety, superannuation, tax and industry laws.
- Correctly assess whether a worker is an employee or independent contractor and do not use Tradies Local to facilitate sham contracting or avoid workplace obligations.
- Provide accurate role, scope, rate, location and engagement information.
- Maintain required workplace and public-liability arrangements for the work you control.
Tradies and trade businesses
- Maintain all licences, registrations, permits, qualifications and insurance required for the services you offer and the jurisdiction in which you work.
- Keep your ABN, business details, service areas and profile information accurate.
- Only quote for or accept work you are legally permitted and reasonably competent to perform.
- Provide clear quotes, variations, invoices and contractual information required by law.
- Perform work safely, professionally and in accordance with applicable laws, codes, standards, permits and contractual obligations.
- Meet your tax, employment, subcontracting, record-keeping and insurance obligations.
5. Job listings, quotes and applications
Users are responsible for the content they submit. A listing, quote, application or message is not reviewed by Tradies Local as professional, legal or technical advice.
- Job listings must be genuine and must not be misleading, unlawful, discriminatory or fraudulent.
- Quotes should identify material assumptions, exclusions, pricing basis and scope where appropriate.
- Users should confirm the final scope, price, timing, payment terms, warranties and variation process directly before work starts.
- Tradies Local may rank, categorise, display or distribute listings according to platform rules, selected paid features, location, category, relevance, safety and integrity signals.
6. Verification and badges
A check is limited to the evidence, method, source, jurisdiction and date described. An ABN check does not establish trade licensing, insurance, skill or suitability. Sighting a licence document is different from checking the issuing regulator's register. Insurance evidence does not establish cover for every activity or claim.
Only checks actually completed may support a badge. The badge explanation must identify the check and its material limitations, including the check date and relevant licence scope. No ongoing monitoring, police check, inspection or independent authentication is implied unless specifically described and performed. See the Verification Policy.
Credentials may expire or change after a check. Users must maintain accurate details and independently confirm suitability for the proposed job. We may pause or remove an unsupported, expired or credibly disputed badge while assessing evidence. Verification is not a guarantee of workmanship or an excuse for misleading platform claims.
Which checks apply?
- Tradies and trade businesses: business/ABN details, the trade licence required for the offered work and jurisdiction, and insurance evidence relevant to that work or specifically requested.
- Business owners hiring: business/ABN details where applicable and authority to act for the organisation. Posting a hiring opportunity does not itself require a trade licence or trade insurance. If the business also offers trade services, the relevant provider checks apply.
- Identity clarification: photo ID may be sighted when reasonably necessary to clarify the representative’s identity or authority. A business register match alone does not prove that the applicant is authorised to act.
Evidence and review process
The Verification Guide explains the manual-check approach and what to prepare. We confirm the relevant check, purpose and submission method before requesting evidence. The guide is explanatory: it does not activate an upload service or certify that a check has occurred. A register check must not be represented as complete where only a document was sighted.
For an initial insurance review, a certificate of currency is normally requested instead of a full policy. If photo ID is sighted by an arranged video call under the guide’s proposed process, the call is unrecorded and no screenshots are taken. Any different collection method must be explained before use, with appropriate privacy information. Do not send unsolicited selfie or driver-licence images by SMS or post them publicly.
What a completed check does not promise
A completed check is not a recommendation, professional accreditation, background or police check, inspection, guarantee of identity, assurance against impersonation or fraud, or promise of safe or competent work. It does not establish solvency, employment eligibility, financial reliability or that insurance will respond to a claim. A visually plausible document or matching register entry can still be misused; manual checks cannot detect every forgery or later change.
Customers and hiring businesses must independently confirm the person’s authority, current licence scope, required cover and suitability for their particular job before engaging them, and agree scope, price, safety, payment and variations directly. Providers remain responsible for lawful work, current credentials and insurance, and must promptly report expiry, cancellation, suspension, restrictions or material changes.
Allocation of responsibility
To the maximum extent permitted by law, Tradies Local does not assume liability for a user’s independent fraud, false evidence, expired credentials, uninsured activities, defective work, injury, property damage, non-payment or other breach merely because an account or credential was checked. This allocation applies only to the extent we did not cause or contribute to the loss through a breach of our own obligations. Sections 16–18 preserve non-excludable rights and govern responsibility for loss. No badge transfers the user’s trade, employer, safety or insurance obligations to us.
7. Platform fees, offers and refunds
We use direct Australian-dollar pricing, not credits or tokens. Current Basic accounts are pay-as-you-go, with no recurring Basic subscription. A platform fee is separate from payment for work between users. Tradies Local does not charge commission on the value of work completed between users. This applies across all plans.
Current offers
- Homeowner job listings are free under the current offer and remain active for two weeks, subject to lawful moderation.
- Tradie Basic and Business Basic job leads are currently free. This does not waive the separate one-time registration fee for new tradie and business-owner accounts.
- Enter LAUNCH80 at signup for 80% off the applicable registration fee. The registration offer is valid until 31 January 2027. The final fee, discount and any GST must be shown before payment. Do not pay unless the displayed total reflects the offer you intend to accept.
- The current offers and inclusions are shown on Plans & Pricing. Ending or changing an offer does not retrospectively change an accepted purchase or authorise a new charge.
Payment processing
Tradies Local uses Stripe to handle platform payments through Stripe’s payment gateway. You authorise only the amount and any expressly selected recurring arrangement disclosed before payment. Stripe processing does not remove our obligations to supply the purchased platform service or provide applicable refunds and remedies. Payment processing for platform fees does not make us an escrow provider or guarantor for trade payments between users.
Registration service and charges
Before charging, the purchase description must identify what the registration service supplies, the amount payable including compulsory charges and GST treatment, the activation or delivery conditions, and any stated duration or limits. The fee is for that described platform service, not a promise of approval, leads, work, customers or revenue. Registration does not guarantee that a particular credential will be verified.
A registration fee is earned only to the extent the described service has actually been supplied. Once correctly supplied, no change-of-mind refund is offered merely because you stop using the service or do not obtain work. If an application is rejected or withdrawn before the service is fully supplied, we assess the service actually delivered and refund any amount required for the unsupplied component. We do not retain a fee merely because it is labelled non-refundable.
Errors, non-supply and statutory remedies
Incorrect or duplicate charges, an unhonoured accepted offer, non-supply, defective services and other applicable consumer rights are assessed on their merits. We provide the refund, correction, re-supply, cancellation or other remedy required by the purchase terms and law. Where a monetary refund is due, platform credit is not imposed instead. An advertising error does not automatically confer the advertised benefit; its resolution must comply with law.
Report a billing issue to support@tradieslocal.com.au with the transaction reference, date, amount and explanation. Do not send full card details or security codes. No internal complaint deadline removes statutory rights.
Subscription credits and renewal
For any recurring subscription you expressly select, credits included in each billing period are valid only for that period. Unused subscription credits expire at the end of the period and do not roll over, accumulate or transfer to the next period. The credit allowance and exact expiry date, time and timezone must be shown before purchase and in the subscription details. This rule applies to included subscription credits; separately purchased credit packs retain the validity disclosed when purchased.
The subscription and its new credit allowance renew only after the recurring payment is successfully processed. A pending, declined or failed payment does not issue new credits or extend expired credits. Any payment retries, service restrictions and the start and end of a period activated after delayed payment must be disclosed; customers must not be charged for an unavailable period without an agreed remedy. Cancellation stops further renewal attempts.
Cancelling recurring payments
You can cancel automatic renewal and future recurring payments at any time using the cancellation facility supplied with the subscription, or by emailing support@tradieslocal.com.au if that facility is unavailable. A request received before the next recurring charge takes effect stops that charge and later renewals. We confirm cancellation and the access end date. Cancellation does not require account deletion.
Access and remaining subscription credits continue until the end of the already-paid period, when unused subscription credits expire without rollover. Cancellation does not automatically refund a correctly supplied paid period or remove an amount already lawfully owed. Refunds and remedies required by applicable law, including for incorrect charges or non-supply, remain available. Cancellation does not authorise a replacement plan, fresh registration fee or other new charge.
Future paid features
A subscription or add-on is available only when expressly offered and selected. Before any recurring purchase, the price, minimum commitment, billing interval, renewal time and timezone, cancellation route, inclusions and expiry must be disclosed. Browsing, registration, an expired free offer or a policy update does not itself authorise payment. See the Subscription Policy.
8. Payments between users
Unless a specific feature expressly says otherwise, customers and tradies arrange payment for the underlying work directly with each other. Tradies Local is not an escrow provider and does not guarantee payment, debt recovery, chargebacks, deposits, progress payments or completion of work.
Users should use appropriate written contracts, invoices and payment records and should take reasonable precautions before transferring deposits or other funds.
9. Reviews and ratings
Reviews should reflect a genuine first-hand experience or identifiable platform interaction and must comply with our Reviews & Ratings Policy.
- Fake, purchased, coordinated, retaliatory or misleading reviews are prohibited.
- Users must not offer an undisclosed benefit in exchange for a positive review.
- Reviews must not contain threats, unlawful discrimination, private information, irrelevant abuse or content that infringes another person's rights.
- We may investigate, label, restrict or remove content where reasonably necessary for platform integrity or legal compliance.
- A review represents the reviewer's opinion or experience, not Tradies Local's endorsement. Reviews are not guaranteed proof of completed work. Any verified-interaction label must describe the evidence actually checked. Ratings must reflect published eligible reviews; paid features do not purchase a favourable rating.
10. Acceptable use
You must not use Tradies Local to:
- break the law, facilitate unsafe or unlicensed work, or encourage another person to do so;
- engage in fraud, scams, phishing, identity misuse or payment deception;
- harass, threaten, stalk, discriminate against or intimidate another user;
- publish false credentials, fake jobs, fake reviews or misleading pricing;
- scrape, harvest, reverse engineer, disrupt or overload the platform, except to the extent such restriction cannot lawfully apply;
- introduce malicious code, interfere with security controls or attempt unauthorised access;
- use personal information obtained through the platform for unrelated marketing, data brokerage or other unauthorised purposes; or
- send unlawful spam or unsolicited commercial communications.
11. User content and intellectual property
You retain ownership of your content, subject to third-party rights. You grant us a non-exclusive, worldwide, royalty-free licence only to host, reproduce, format and display it as reasonably necessary to provide and secure the selected platform service and display the listing or profile you choose to publish. Service providers may process it for these limited purposes. Private messages and verification evidence are not licensed for unrelated advertising.
You must have the rights and necessary permissions to submit content. Do not upload confidential plans, photographs or another person's details without authority. We may restrict material reasonably suspected to infringe rights and seek evidence or a response.
When content is removed or an account closed, the licence ends except to the extent reasonably needed for existing lawful records, backups, disputes, security or legal obligations. Removal cannot recall copies independently made by other users or search engines. It does not authorise indefinite retention or new promotional use.
Our branding, software, layout and original materials remain owned by or licensed to us. Third-party tools, resources and links remain subject to their owners' rights. No permission is granted to copy or exploit them beyond what law or an express licence permits.
12. Privacy and communications
Personal information is handled in accordance with our Privacy Policy and applicable privacy law. Platform messages, security notices, billing notices and selected job alerts may be sent as part of the service. Marketing emails or SMS are managed separately and must comply with applicable consent and unsubscribe requirements.
Users must not disclose another person's personal information through public listings or messages unless authorised and reasonably necessary.
13. Suspension, restriction and termination
You may request account closure through support@tradieslocal.com.au. Closure stops access but does not automatically erase records lawfully needed for billing, security, legal compliance or a live dispute. Accrued payment obligations and statutory rights remain.
We may take proportionate protective action for substantiated breaches, credible fraud or safety risks, false credentials, platform-security abuse, non-payment of an authorised charge or legal requirements. Where reasonably practicable, we explain the issue and provide a chance to correct it before significant adverse action. Immediate restriction may be necessary for an urgent risk; it is not an automatic finding of wrongdoing.
You may ask for review and submit evidence through the same contact. We assess relevant evidence, explain the outcome to the extent lawful, and reconsider restrictions where their basis no longer applies. A different reviewer may be used where practicable. We need not disclose another person's private details or information that would compromise security or legal obligations.
Termination does not automatically forfeit all prepaid fees. We assess services supplied, unused entitlements, any lawful amount owing and applicable refunds. We do not charge a penalty merely for raising a complaint or exercising a statutory right.
14. Complaints and disputes
For platform, billing, moderation, credential or content complaints, email support@tradieslocal.com.au or use the Contact page. You do not need an account to email a report. Identify the issue, relevant content URL or transaction, dates, supporting evidence and the outcome sought. Do not send unnecessary sensitive information.
We assess complaints within a reasonable period according to their seriousness, urgency and complexity. Where further information or time is needed, we explain the next step. Urgent safety, privacy and unlawful-content reports require prompt assessment. Privacy requests follow the Privacy Policy.
Workmanship, scope, defects, employment, delays and trade-payment disputes generally concern the users who contracted for that work. We may facilitate communication or preserve relevant platform records where appropriate, but do not act as a court, inspector, debt collector or guarantor. This does not exclude responsibility for our own platform conduct.
Internal processes do not prevent urgent relief, a complaint to a regulator, or access to a court or tribunal with jurisdiction. The ACCC receives reports but does not resolve individual consumer disputes; state or territory consumer agencies may offer individual assistance. Call 000 for immediate danger.
15. Platform availability and changes
Maintenance, outages, cyber incidents and third-party failures may interrupt access. We do not guarantee uninterrupted access, delivery of every alert or permanent availability of a free feature. Keep your own copies of important quotes, agreements and records.
We remain responsible for reasonable care in supplying our own services and for obligations that cannot be excluded. An outage or third-party failure is not an automatic exemption from that responsibility.
We may improve or discontinue features for legitimate operational, security or legal reasons. For a material reduction in an already-purchased service, we provide appropriate notice where practicable and any cancellation, unused-portion refund or other remedy required by the contract or law. An alternative service or credit does not replace a monetary refund where one is due.
Tool Box and external resources
Calculator results depend on your inputs, assumptions and rounding. Examples are planning aids, not site-specific engineering, legal, tax or financial advice, certified designs, product specifications or binding trade quotes. Check measurements, suitability, current requirements and professional advice before ordering materials or undertaking work. External resources are controlled by their publishers; a link does not guarantee their content. These limitations do not exclude responsibility for our own misleading claims or non-excludable obligations.
16. Australian Consumer Law
Nothing in these Terms excludes consumer guarantees or other rights that cannot be excluded. Tradies Local's own platform services may carry guarantees under the Australian Consumer Law where that law applies. Separately, consumer rights relating to the underlying trade service generally apply against the tradie or business that supplied that service.
Any disclaimer, exclusion or limitation in these Terms operates only to the maximum extent permitted by law.
17. Liability and risk allocation
Users contract for underlying work directly and are responsible for their own workmanship, safety, legal compliance and payment obligations. Tradies Local does not assume those obligations merely by displaying a listing, facilitating contact or conducting a limited credential check.
To the extent lawful, we are not responsible for loss caused by another user's independent conduct or circumstances outside our reasonable control where we have not caused or contributed to that loss through a breach of our own obligations. Each party remains responsible to the extent its conduct caused the loss.
We do not exclude liability for our fraud, wilful misconduct or liability that cannot lawfully be excluded, including applicable consumer guarantees and privacy obligations. A loss is not excluded merely because it is called indirect or consequential. Foreseeability, causation, mitigation and applicable law determine recoverable loss. No automatic liability cap equal to fees paid is imposed by these Terms.
18. Claims caused by user conduct
To the extent permitted by law, you are responsible for reasonable third-party claims and losses caused by your fraud, unlawful conduct, material breach or infringement of rights through content you had no right to submit. Responsibility is limited to your contribution and excludes loss caused by our negligence, unlawful conduct or breach.
We must notify you of a claim within a reasonable period, provide relevant details where lawful, allow reasonable participation in its defence, take reasonable steps to limit loss and substantiate claimed costs. We will not agree to a settlement imposing liability on you without your consent, not to be unreasonably withheld. There is no double recovery or automatic right to unlimited legal costs.
19. Changes to these Terms
We may revise these Terms for changes in law, features, security or business operations. The revised version and date will be displayed here. Material adverse changes affecting an ongoing paid service or significant existing right require reasonable advance notice through an appropriate direct channel and a meaningful opportunity to stop future renewal or use before they apply. An update does not authorise an additional charge.
Accepted purchases and accrued rights are not retrospectively removed. Where a material change prevents supply of an already-paid service, the remedies in sections 7 and 15 apply. Urgent legal or security changes may need immediate effect, limited to what is reasonably necessary, with an explanation when lawful and practicable. New consent is obtained where required.
20. General terms and contact
Tradies Local Australia is a registered business name of LOTAY PTY LTD, ABN 62 674 969 923. Notices, billing issues and complaints can be sent to support@tradieslocal.com.au. A service address must be confirmed and published before production signup or payment is accepted.
- Governing law: Victoria, Australia, subject to mandatory rights elsewhere. Jurisdiction is non-exclusive; this clause does not prevent access to a court or tribunal available under mandatory law.
- Severability: an unenforceable provision is read down or severed only to the extent lawful, without removing mandatory protections.
- No waiver: delay in exercising a right does not automatically waive it.
- Order of documents: mandatory law prevails. An expressly agreed purchase-specific term governs that purchase; otherwise these Terms prevail over conflicting Platform Policies. The Privacy Policy is an information-handling notice and does not give blanket consent.
Local preview: this website preview does not process platform payments or activate marketplace accounts. These revised pages do not establish that production payment, verification or privacy systems are implemented.
